New unfair trading practices laws to commence 1 July 2027

The Competition and Consumer Amendment (Unfair Treating Practices) Bill 2026 (the Bill) passed both Houses of Parliament, following a lengthy consultation process and a landmark shift in Australia’s consumer protection framework. The bill amends the Australian Consumer Law (set out in Schedule 2 to the End Consumer Act 2010 (Cth) by introducing reforms to enhance consumer protections against existing and evolving unfair trading practices.

The reforms will commence on 1 July 2027 and will:

  • introduce a general prohibition on unfair trading practices towards consumers;
  • address unfair subscription practices; and
  • enhance protections against trip pricing by introducing disclosure obligations on businesses

Organisations that contravene the new laws face significant pecuniary penalties.
