New code of practice on workplace sexual and gender-based harassment
The Government approved a new Work Health and Safety (Sexual and Gender-based Harassment) Code of Practice 2025. This Code provides practical guidance to employers on how they can identify, manage, and minimise risks of sexual and gender-based harassment at work, and meet their obligations under Work Health and Safety (WHS) Laws.
The Code is not law, but can be used in courts as evidence. It recognises that leaders play a key role in creating safe and respectful workplaces. The Code providers a risk management process consistent with a risk assessment to eliminate or minimise the risk of sexual and gender-based sexual harassment:
- identifying risks and hazards
- assessing them
- implementing control measures, and
- monitoring/reviewing control measure to ensure they are effective
Input from employees is critical, with employers required to consult employees at each stage of the risk management process.
